Possession:
Possession on Tract 1 will be at closing with the Purchaser receiving the landowners 1/3 share of the harvested wheat delivered to the elevator in Purchasers name. Purchaser will be responsible for their 1/3 share of the cost related to the crop including but not limited to fertilizer, crop insurance, and any other expenses that may be needed in the spring.

Possession on Tract 2 will also be at closing. In the event the milo acres are not harvested at closing, possession on those acres will be after the completion of the said harvest. Purchaser to pay the tenant $688.23 for chemical and application on approximately 59 acres of wheat stubble.

Terms:
10% down day of sale, balance to be paid upon title approval and delivery of deed, said closing on Tract 1 to be on or before December 20th, 2019 and closing on Tract 2 to be after January 2nd, 2020 and before January 8th, 2020, or as soon as title requirements, if any, can be corrected. Sale is not contingent on purchaser obtaining financing. Financing, if necessary, needs to be approved prior to the auction.  The seller agrees to convey said property by a good and sufficient Deed to the purchaser, subject to easements, restrictions, roads, right-of-ways, leases, reservations and county zoning regulations of record.  Said deed shall be delivered to the purchaser at the time of settlement. Seller(s) to furnish title insurance showing merchantable title in Seller. These tracts are being sold by U.S. Government survey. If the PURCHASER feels an additional survey is needed, the cost shall be the responsibility of the PURCHASER(S).
